Terms of Use
These terms govern your use of OpenHeat, a free dating and social platform for adults only. By registering you agree to them. Courtesy translation; the German version is binding. [Date of publication]
1. Provider and scope. The provider is the operator named in the Legal Notice. OpenHeat is aimed at users in Germany, Austria, Switzerland and the EU/EEA. [Open decision: expressly exclude use from other countries or merely not promote it]
2. Services. You can create a profile, discover other members, send likes and friend requests, chat with matches and friends, report or block members, and optionally obtain a verified profile (“Trusted profile”). We do not guarantee matches or meetings. Demo profiles are marked as such and never create matches. The service is free; any paid features would come with separate terms.
3. Requirements. You are at least 18 years old and give truthful details of your name, date of birth and place of residence. You have at most one account. You sign in with an AILinux or Google account. Anyone under 18 may not use OpenHeat; we block such accounts and delete their data.
4. Rules. Consent and respect come first. Not allowed:
- harassment, pressure, threats, hate speech and discrimination
- contact with or depiction of minors
- false identities, other people’s photos, fake profiles
- intimate images or videos of a person without their consent; sexually explicit photos or text in your profile
- fraud, requests for money, advertising, spam, selling goods or services
- soliciting prostitution, human trafficking or violence
- scraping other members’ data and circumventing blocks or safety features
- any other unlawful content
5. Your content. Your content remains yours. You grant us a simple, non-exclusive right to store it and show it to other members to operate OpenHeat; the right ends when you delete it. You confirm you hold the necessary rights, especially to your photo. A photo is private by default and becomes public only if you turn that on.
6. Moderation. You can report and block members. Several independent reports about one profile hide it automatically until review; people carry out the review and make the final decision. For violations we may remove content and suspend or delete accounts. We tell you what we restricted and why (Art. 17 DSA). You can appeal by email and we review it promptly. We have no duty to review content in advance.
7. Safety and meetings. You are responsible for your contacts and meetings. We run no background checks. “Trusted profile” only confirms that age and identity were matched at the time of checking; it says nothing about a person’s trustworthiness. Please follow our safety tips.
8. Availability and changes. We aim for trouble-free operation but cannot promise it. Features may change. We announce changes to these terms at least 30 days ahead by email or in the app; until then you can delete your account free of charge.
9. Term and termination. You can delete your account at any time (Profile → Delete account). We may suspend or terminate an account for good cause, in particular for violations of sections 3 or 4. What happens to your data afterwards is set out in the Privacy Policy.
10. Liability. We are liable without limit for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where the law mandates it. For slight negligence we are liable only for breach of essential contractual obligations and limited to foreseeable, typical damage. We are not liable for the content or conduct of other members.
11. Governing law. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected. For consumers the statutory place of jurisdiction applies; for merchants it is the provider’s seat.
12. Final provisions. If a provision is invalid, the rest stays valid. The German version is binding; the English one is a courtesy translation.
Nutzungsbedingungen
Diese Bedingungen regeln die Nutzung von OpenHeat, einer kostenlosen Dating- und Kennenlernplattform nur für Erwachsene. Mit der Registrierung stimmst du ihnen zu. [Stand: Datum der Veröffentlichung]
1. Anbieter und Geltungsbereich. Anbieter ist der im Impressum genannte Betreiber. OpenHeat richtet sich an Nutzer in Deutschland, Österreich, der Schweiz und der EU/dem EWR. [Entscheidung offen: Nutzung aus anderen Staaten ausdrücklich ausschließen oder nur nicht bewerben]
2. Leistungen. Du kannst ein Profil anlegen, andere Mitglieder entdecken, Likes und Freundschaftsanfragen senden, mit Matches und Freunden chatten, Mitglieder melden oder blockieren und optional ein geprüftes Profil („Trusted profile“) erhalten. Wir garantieren weder Matches noch Treffen. Demo-Profile sind als solche gekennzeichnet und erzeugen keine Matches. Die Nutzung ist kostenlos; kostenpflichtige Funktionen würden wir nur mit gesonderten Bedingungen anbieten.
3. Voraussetzungen. Du bist mindestens 18 Jahre alt und machst wahrheitsgemäße Angaben zu Name, Geburtsdatum und Wohnort. Du hast höchstens ein Konto. Die Anmeldung erfolgt über ein AILinux- oder Google-Konto. Wer unter 18 ist, darf OpenHeat nicht nutzen; wir sperren solche Konten und löschen die Daten.
4. Regeln. Einverständnis und Respekt kommen zuerst. Nicht erlaubt sind:
- Belästigung, Druck, Drohungen, Hassrede und Diskriminierung
- Kontakt zu oder Darstellung von Minderjährigen
- falsche Identitäten, fremde Fotos, Fake-Profile
- intime Bilder oder Videos ohne Einwilligung der gezeigten Person, sexuell explizite Darstellungen in Profilfoto oder Profiltext
- Betrug, Geldforderungen, Werbung, Spam, Verkauf von Waren oder Dienstleistungen
- Anbahnung von Prostitution, Menschenhandel oder Gewalt
- Auslesen von Daten anderer Mitglieder (Scraping) und Umgehen von Sperren oder Sicherheitsfunktionen
- jeder sonstige rechtswidrige Inhalt
5. Deine Inhalte. Deine Inhalte bleiben deine. Du räumst uns das einfache, nicht ausschließliche Recht ein, sie zum Betrieb von OpenHeat zu speichern und anderen Mitgliedern anzuzeigen; das Recht endet mit der Löschung. Du versicherst, dass du die dazu nötigen Rechte hast, insbesondere am Foto. Ein Foto ist standardmäßig privat und wird nur öffentlich, wenn du es aktivierst.
6. Moderation. Du kannst Mitglieder melden und blockieren. Mehrere unabhängige Meldungen zu demselben Profil verbergen es automatisch bis zur Prüfung; die Prüfung und die endgültige Entscheidung treffen Menschen. Bei Verstößen können wir Inhalte entfernen und Konten sperren oder löschen. Wir teilen dir mit, was wir beschränkt haben und warum (Art. 17 DSA). Dagegen kannst du per E-Mail Einspruch einlegen; wir prüfen ihn zeitnah. Eine Pflicht, Inhalte vorab zu prüfen, besteht nicht.
7. Sicherheit und Treffen. Du bist für deine Kontakte und Treffen selbst verantwortlich. Wir führen keine Hintergrundprüfungen durch. Das „Trusted profile“ bestätigt nur, dass Alter und Identität zum Zeitpunkt der Prüfung abgeglichen wurden – es sagt nichts über die Vertrauenswürdigkeit einer Person. Beachte unsere Sicherheitshinweise.
8. Verfügbarkeit und Änderungen. Wir bemühen uns um einen störungsfreien Betrieb, können ihn aber nicht zusichern. Funktionen können sich ändern. Änderungen dieser Bedingungen kündigen wir mindestens 30 Tage vorher per E-Mail oder in der App an; du kannst dein Konto bis dahin kostenlos löschen. 9. Laufzeit und Beendigung. Du kannst dein Konto jederzeit selbst löschen (Profil → Konto löschen). Wir können ein Konto aus wichtigem Grund sperren oder kündigen, insbesondere bei Verstößen gegen Ziffer 3 oder 4. Was danach mit deinen Daten geschieht, steht in der Datenschutzerklärung.
10. Haftung. Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei Verletzung von Leben, Körper und Gesundheit, nach dem Produkthaftungsgesetz und soweit das Gesetz sie zwingend vorschreibt. Bei leichter Fahrlässigkeit haften wir nur für die Verletzung wesentlicher Vertragspflichten und begrenzt auf den vorhersehbaren, typischen Schaden. Für Inhalte und Verhalten anderer Mitglieder haften wir nicht.
11. Anwendbares Recht. Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Zwingende Verbraucherschutzvorschriften deines Wohnsitzstaates bleiben unberührt. Für Verbraucher gilt der gesetzliche Gerichtsstand; für Kaufleute ist er der Sitz des Anbieters.
12. Schlussbestimmungen. Ist eine Regelung unwirksam, bleibt der Rest wirksam. Maßgeblich ist die deutsche Fassung; die englische ist eine Übersetzung zur Information.
